Do I need a local entity in Dominica to hire?
No. There are three routes:
- Employer of Record. Dryft Global employs the person through a compliant local employer registered with Dominica Social Security (DSS) and the Inland Revenue Division (IRD), issues the written particulars the Labour Standards Act requires, and runs payroll with both monthly remittances. You direct the work.
- Direct local entity. You register with the Companies Registry, open DSS and IRD accounts and engage a local accountant to run payroll: 8 to 14 weeks before you can pay anyone.
- Independent contractor. Lawful only for a genuinely independent business. If the person works like an employee, the Labour Division and DSS will treat them as one.
When should I use an EOR instead of registering locally?
Use an EOR to onboard in 3 to 7 business days instead of waiting on the Companies Registry, to build a remote team of roughly 1 to 10 people, or to avoid standing up local tax and DSS administration for a handful of hires. Your own entity earns its keep when you need premises or a large permanent footprint. Note that unlike several of its Eastern Caribbean neighbours, Dominica does operate a personal income tax, so payroll here carries a real withholding obligation.
What does an employee actually cost beyond salary?
Plan for roughly 26% to 33% on top of gross base salary. The statutory piece is employer DSS at 7.00% of insurable earnings, capped at XCD 7,000 a month, about USD 2,592.59, which puts a hard ceiling of XCD 490 a month on the employer contribution. Paid vacation and public holiday accrual, private medical cover and a pension match make up the rest. There is no employer-side income tax: PAYE is withheld from the employee.
How difficult is termination in Dominica?
Manageable, but procedural. The Protection of Employment Act sets a written notice schedule that rises with service, and redundancy after at least 2 years of continuous service triggers statutory severance calculated per completed year on tenure tiers. Redundancy exercises need formal written notification to the employee and to the Labour Division. Summary dismissal without notice is available only for serious, documented misconduct following a fair procedural inquiry.

What an employee costs in Dominica
Dominica is cheap on statutory employer cost and slightly higher than its neighbours on the contribution rate itself. There is only one employer contribution, DSS, and it stops at a low ceiling, so the effective percentage falls quickly on professional salaries. Payroll and tax
Wages are paid monthly or biweekly. Salaries can be stated in XCD or USD and converted at the fixed 2.70 peg under the Eastern Caribbean Central Bank, so there is no currency risk to hedge. Two separate deadlines drive the month: DSS contributions are due by the 14th of the following month and PAYE to the Inland Revenue Division by the 15th. Missing the DSS date is the single most common compliance failure here. Register with the IRD for PAYE withholding and with DSS within 7 days of hiring, and keep wage, time-tracking and leave records for at least 5 years.
Graduated PAYE withholding
Unlike several neighbouring islands, Dominica taxes personal income, and the employer is the withholding agent. Tax is progressive: a standard personal allowance covering the first XCD 25,000 to 30,000 a year at 0%, then bands at 15%, 25% and a top marginal rate of 35%. Allowances and band thresholds move, so confirm the current schedule with the Inland Revenue Division before you commit to a net-pay figure in an offer letter.
Statutory minimum wage
Dominica sets minimum wages by sectoral order rather than a single national rate, so the applicable floor depends on the role category. The guide puts the range at about XCD 7.50 to 9.00 or more an hour, with knowledge-sector market rates far above that at XCD 2,400 to 7,500 or more a month, roughly USD 888 to 2,777. Check the order that covers your role category before setting a band.
Leave and mandatory benefits
- Paid vacation. A minimum of 2 to 3 weeks, 10 to 15 working days, a year under the Labour Standards Act, scaled by completed years of continuous service. Vacation pay must be disbursed before the employee starts the leave.
- Public holidays. 11 to 12 a year, including Carnival Monday and Tuesday, Emancipation Day, Independence Day on 3 November and Community Service Day on 4 November. Work on a public holiday is paid at 2.0 times the normal hourly wage.
- Sick leave. Paid sick leave comes from the Labour Standards Act and the DSS regulations. DSS Sickness Benefit pays 60% of average insurable earnings from day 4 of medical incapacity, and employers customarily bridge the gap to full salary.
- Maternity. A minimum of 12 weeks of continuous leave, typically 3 to 4 weeks before confinement and 8 to 9 weeks after. DSS Maternity Benefit pays 60% of average insurable earnings and employers frequently top up. Termination during pregnancy or maternity absence is prohibited.
- No statutory paternity or 13th month. Neither is mandated, so both are matters for the contract.
- Working time. 40 hours a week, 8 hours a day, an unpaid meal interval of 45 to 60 minutes and 24 to 48 consecutive hours of weekly rest. Overtime beyond 8 hours a day or 40 a week is paid at 1.5 times. Bona fide managerial staff are exempt from overtime pay, but the exemption has to match the real role.
- Supplementary benefits. Expected for skilled roles though not statutory: group major medical covering hospitalisation in Dominica, the wider Caribbean and North America, a defined contribution pension match of 3% to 5%, and a remote workspace allowance of USD 50 to 125 a month for fibre and power continuity.
Termination and notice periods
Probation runs to a maximum of 6 months. After that the Protection of Employment Act notice schedule applies, in writing, and a contract can improve on it but not reduce it.

- Redundancy severance starts at 2 years. Employees terminated for redundancy after at least 2 years of continuous service are entitled to statutory severance, calculated per completed year of service on the statutory tenure tiers.
- Redundancy is a notified process. A redundancy exercise requires formal written notification to the employee and to the Labour Division, not just a conversation and a final payslip.
- Summary dismissal is narrow. Available only for serious, documented misconduct, and only after a fair procedural inquiry in which the employee has had a chance to answer.
- Disputes end up at the Labour Division. Unfair dismissal protections sit in the Protection of Employment Act, and the Industrial Relations Act governs union recognition and trade dispute resolution. Dominica's final court of appeal is the Caribbean Court of Justice.
Can I use independent contractors?
Only where the person is genuinely running their own business: their own equipment, their own schedule, their own client base, invoices against output rather than a recurring salary. A full-time worker embedded in your management line and systems is an employee whatever the paperwork says. Misclassifying one creates a stack of liabilities at once: unremitted DSS contributions at the combined 13%, IRD PAYE back taxes, interest penalties on both, and statutory holiday and severance claims before the Labour Division. Because Dominica has a real income tax, the tax exposure here is larger than in the zero-income-tax islands nearby. For anyone who works like an employee, an EOR is the compliant route.
The legal framework in brief
Dominica is a common law jurisdiction inside the Eastern Caribbean Supreme Court structure, and it has acceded to the appellate jurisdiction of the Caribbean Court of Justice, which is its final court of appeal for civil, criminal and labour disputes. The instruments you will hear most:
- Labour Standards Act (Chap. 89:05). Minimum wages, hours of work, overtime, annual vacation leave, sick leave and the written particulars due within 14 days.
- Protection of Employment Act (Chap. 89:02). Termination, notice, redundancy procedure, statutory severance and unfair dismissal protection.
- Social Security Act (Chap. 31:01). DSS registration, insurable wage ceilings, contribution collection and the sickness, maternity and pension benefits employees draw.
- Industrial Relations Act (Chap. 89:01). Trade union recognition, collective bargaining and trade dispute resolution.
- Data protection. No GDPR-style statute; obligations rest on common law confidentiality and regional privacy standards. Carry the load contractually and technically: device encryption, multi-factor authentication and secure VPN across every remote endpoint.
- Immigration and right to work. Citizens and CARICOM Single Market and Economy skills certificate holders work without permits. Other foreign nationals need a permit through the Ministry of Labour and the Immigration Department. The Work in Nature (WIN) extended stay visa lets qualifying remote workers live on-island for up to 18 months while working exclusively for foreign employers.
- Authorities. Dominica Labour Division, Dominica Social Security and the Inland Revenue Division.
