What a foreign company needs to know before employing people in the Bahamas: whether you need an entity, what an employee really costs where there is no income tax to withhold, and why work authorisation and the termination schedule shape the planning. Do I need a Bahamian entity to hire?
No. There are three routes:
- Employer of Record. Dryft Global employs the person through a compliant Bahamian employer registered with the National Insurance Board (NIB), issues the written particulars the Employment Act requires, runs payroll and files the monthly C-10 return. You direct the work.
- Direct local entity. You incorporate, register with the NIB, take out a business licence and run payroll yourself: 8 to 16 weeks and USD 5,000 to 15,000 or more in outlay, plus resident agent and audit costs.
- Independent contractor. Lawful only for genuinely autonomous specialists. If the daily reality looks like employment, the NIB and the Department of Labour will treat it so.
When should I use an EOR instead of incorporating?
Use an EOR to onboard in 3 to 7 business days instead of waiting on incorporation and bank onboarding, to build a team of 1 to 15 remote knowledge workers, or to test the market. Your own entity becomes the right answer above roughly 20 to 50 permanent staff, or when you trade domestically. Either way, plan around work authorisation: the Bahamas enforces a strict localisation policy, so your hires will in practice be citizens or permanent residents with the right to work.
What does an employee actually cost beyond salary?
Plan for roughly 28% to 34% on top of gross base salary once contributions, paid leave accrual and market-standard benefits are counted. The statutory piece is small: employer NIB contributions of 5.90% of insurable wages, capped at BSD 740 a week, about BSD 3,207 a month, with no employer payroll tax and no income tax to withhold.
How difficult is termination in the Bahamas?
Manageable, but nothing like at-will. The Employment Act, 2001 sets a notice schedule and a redundancy formula you cannot contract below. Poor performance or minor misconduct needs progressive discipline: written warning, an improvement window of typically 30 to 60 days, second warning, then notice or pay in lieu. Summary dismissal is available only for proven gross misconduct. Unfair dismissal goes to the Industrial Tribunal, which can order reinstatement.

What an employee costs in the Bahamas
Statutory employer cost here is unusually light: no income tax to withhold, no payroll tax, no statutory pension beyond national insurance. What fills the gap is paid leave accrual and the private medical cover the market expects. The guide models a knowledge worker on USD 4,500 a month.

Counting cash items only, the guide's worked example puts a USD 4,500 a month salary at USD 5,289.21 all-in before the EOR fee, about 17.5% over base. Because NIB stops at the ceiling, that percentage falls as salaries rise. Ask us for a cost model with current rates applied.
Payroll and tax
Wages may be paid weekly, biweekly or monthly; monthly salaries must reach the employee by the final working day of the month. Contracts can be denominated in BSD or USD, which trade at parity. Every pay run needs an itemised pay statement showing gross wages, the pay period, the insurable wage calculation, NIB deductions and net pay. Keep payroll and time records on-island for 3 to 5 years.
No income tax withholding
The Bahamas levies no personal income tax on salaries, wages, capital gains or dividends, so there is no PAYE to operate. Your one recurring statutory filing is national insurance: NIB C-10 returns and payments must reach the Board by the 15th of the following month, and late payment attracts interest of 10% a year. Register with the NIB within 10 days of your first hire. Value Added Tax of 10% applies domestically; it is not charged on wages, but intercompany management fees need a VAT review.
Statutory minimum wage
A single national minimum wage applies to every role on every island, set by government order. The guide gives BSD 260.00 a week, that is BSD 6.50 an hour on a 40-hour week or BSD 52.00 for an 8-hour day. Collective agreements in hospitality and the public corporations set higher floors, and knowledge-worker rates sit far above the minimum. Equal pay for equal work is a statutory obligation.
Leave and mandatory benefits
- Paid vacation. Two weeks, 10 working days, for 1 to 4 years of service, rising to three weeks, 15 days, from 5 years. Vacation pay is due before the leave starts, leave cannot be forfeited without a real chance to take it, and untaken days are paid out on termination.
- Public holidays. 11 to 12 a year, including Majority Rule Day, Randol Fawkes Labour Day, Independence Day and Emancipation Day. One falling on a weekend is proclaimed on the following Monday. Holiday work is paid at double time.
- Sick leave. After 6 months of service, 1 week, 5 working days, a year; a medical certificate can be required beyond 2 consecutive days. Past 3 days the employee claims NIB Sickness Benefit at up to 60% of average insurable earnings, and employers customarily top up.
- Maternity. 12 weeks after 12 months of service. The employer pays at least one third, 33.33%, of basic wage and the employee claims NIB Maternity Benefit at about 66.66% of insurable earnings, together approaching full replacement. The employer-paid entitlement arises once every 3 years with the same employer. Notice during maternity leave, or because of pregnancy, is unlawful.
- Paternity and 13th month. Neither is mandated. Employers commonly offer 5 to 10 discretionary paternity days; any Christmas bonus is contractual.
- Working time. 40 hours a week over 5 days, 8 hours a day excluding the meal break, an unpaid break of 30 to 60 minutes, 16 hours of rest between workdays and 48 hours of weekly rest. Overtime is 1.5 times base, Sunday and holiday work 2.0 times. Section 8 exempts genuine managerial staff, but only where the job description, real authority and salary support it.
- Supplementary benefits. Expected though not statutory: private major medical including South Florida treatment, a pension match of 3% to 5%, life cover, and a home-office stipend of USD 75 to 150 a month.
Termination and notice periods
Probation runs up to 6 months, customarily 3 to 6, and during it either side can end the contract on about 1 week of notice. After probation the Employment Act schedule applies, and it splits by grade rather than by a single service ladder.

- Progressive discipline is the default. Written warning, an improvement window of typically 30 to 60 days, second warning, then notice or pay in lieu. Skipping the paper trail turns a defensible exit into an unfair dismissal claim.
- Summary dismissal is narrow. Available only for gross misconduct breaking the duty of good faith, such as theft, fraud or a serious confidentiality breach, and only on reasonable proof after a fair investigation.
- Redundancy has a procedure as well as a formula. Permitted where the business closes, downsizes or modernises the role away. Apply objective selection criteria, pay severance plus accrued vacation and earned wages, and notify the Minister of Labour and any recognised union where several people are affected.
- Two separate claims. Wrongful dismissal is a breach of notice, remedied in damages. Unfair dismissal covers termination without fair grounds or in breach of a protection such as union membership or pregnancy, and the Tribunal can order reinstatement.
Can I use independent contractors?
Only for genuinely independent specialists doing discrete work. Bahamian courts and the National Insurance Board apply a common law economic reality test: who controls how, when and where the work is done; whose laptop, licences and systems are used; is the person open to other clients or embedded exclusively in your workflows; and do they carry profit and loss risk and invoice against milestones, or draw a guaranteed salary. Full-time staff on contractor paperwork fail that test. On recharacterisation the NIB can retroactively assess unremitted contributions of 9.8% of wages up to the ceiling with 10% annual interest, and the individual can claim accrued vacation, holiday pay, overtime and severance before the Department of Labour or the Industrial Tribunal.
The legal framework in brief
A common law jurisdiction in the English tradition, with the Privy Council as final appellate court. The instruments you will hear most:
- Employment Act, 2001 (as amended). Written particulars within 7 days, hours, minimum wage, paid leave, termination, redundancy, unfair dismissal, notice and severance.
- National Insurance Act (Chapter 350). Employer registration, insurable ceilings, contribution rates and the sickness, maternity and disability benefits employees draw.
- Industrial Relations Act (Chapter 321). Union recognition, collective bargaining and trade disputes before the Industrial Tribunal.
- Health and Safety at Work Act. Duties on safe working environments, equipment and hazard mitigation, applying to home-working setups too.
- Data Protection (Privacy of Personal Information) Act, 2003. Fair collection, purpose limitation, security and retention limits. Transfer to a parent entity or overseas cloud needs adequate safeguards and explicit consent in the contract. Covert keystroke logging is hazardous: publish a monitoring policy instead.
- Immigration and right to work. Citizens and permanent residents with the right to work can be hired freely. Foreign work permits are strictly scrutinised, need national advertising and Department of Labour clearance, and carry fees of USD 1,000 to 15,000 a year. The Bahamas Extended Access Travel Stay (BEATS) allows remote work from the islands for up to 12 months for a foreign employer only.
- Authorities. Ministry of Labour and the Public Service, Department of Labour, National Insurance Board and Department of Immigration.
Where the talent is
About 400,000 people, concentrated in New Providence and Grand Bahama. Decades of offshore banking, wealth advisory, trust administration and compliance work have built a dense pool of accountants, AML officers, corporate paralegals and operations specialists. English is native, US commercial norms are familiar, and the islands run on Eastern Time. The constraints are real: niche engineering roles take longer to fill, Nassau's cost of living lifts salary expectations, and hurricane season makes power and connectivity redundancy a contractual matter.
