Do I need a Barbadian entity to hire?
No. There are three routes:
- Employer of Record. Dryft Global employs the person through a compliant Barbadian employer registered with the Barbados Revenue Authority (BRA) and the National Insurance and Social Security Service (NISSS), and runs payroll, PAYE, contributions and the paperwork the Employment Rights Act requires. You direct the work.
- Direct local entity. You incorporate through CAIPO, register with the BRA and NISSS, open local banking and run payroll yourself. The guide puts this at 8 to 16 weeks.
- Independent contractor. A contract for services works only for genuinely independent specialists. If the daily reality looks like employment, the Labour Department or the Employment Rights Tribunal will treat it that way. See below.
When should I use an EOR instead of incorporating?
An EOR makes commercial sense when you are:
- Onboarding professionals in 3 to 5 business days rather than waiting on CAIPO and local bank KYC.
- Building a team of 1 to 15 knowledge workers: analysts, accountants, engineers, support specialists.
- Keeping your parent company out of direct exposure before the Employment Rights Tribunal.
Your own entity becomes the right answer above roughly 15 to 20 permanent staff, or when you need commercial premises or a regulated trading licence. An EOR does not by itself remove permanent establishment risk if your person routinely concludes commercial contracts for you.
What does an employee actually cost beyond salary?
Plan for roughly 24% to 32% on top of gross base salary. Employer NISSS contributions run at about 12.85% to 13.35% of insurable earnings but stop at a monthly ceiling of BBD 5,290, so the effective percentage falls fast on professional salaries. The rest is leave and sick pay accrual plus market-standard medical cover. Full breakdown below.
How difficult is termination in Barbados?
Procedurally difficult rather than impossible. There is no at-will employment. Under the Employment Rights Act, 2012 a dismissal is unfair unless it rests on one of four statutory reasons, and for conduct or performance you must first run the three-step Fourth Schedule procedure: written charge, hearing, written decision with a right of appeal. Skip a step and the Tribunal treats the dismissal as unfair whatever the merits. Redundancy carries severance of 2.5 to 3.5 weeks' basic pay per year.

What an employee costs in Barbados
Barbados is predictable on cost. Employer social security stops at a monthly insurable earnings ceiling and there is no statutory 13th month; leave accrual fills the gap. The guide models a senior specialist on BBD 100,000 a year.

For an employee on BBD 100,000 gross a year, the guide's model puts fully burdened cost at about BBD 132,422, roughly 132% of base. Because NISSS stops at the ceiling, that percentage falls as salaries rise. Ask us for a cost model with current rates applied.
Payroll and tax
Wages may be paid weekly, fortnightly, semi-monthly or monthly; professional staff are customarily monthly, in Barbadian dollars to a local account. Section 25 of the ERA requires an itemised pay statement on or before every pay date showing gross earnings, every deduction separately, and net pay. Keep wage, hours, leave and contribution records for at least 5 years, open to inspection.
PAYE withholding
Income tax runs through Pay-As-You-Earn, administered by the Barbados Revenue Authority on TAMIS. Residents get a basic personal allowance of BBD 25,000 a year. Above that, tax is 12.5% on the next BBD 50,000 of taxable income and 28.5% beyond that. Non-residents pay a flat 28.5% with no allowance, unless a treaty applies. PAYE and NISSS are both remitted by the 15th of the following month; late NISSS remittance attracts a surcharge of around 10% plus interest. Annual reconciliation is due February 28.
Statutory minimum wage
A single national hourly minimum wage covers every worker, full-time, part-time or temporary, regardless of nationality or sector. The guide gives BBD 8.50 an hour for standard private sector roles and BBD 9.25 for security officers. Confirm the in-force rate with the Labour Department before setting a pay band. Equal pay for equal work is a statutory obligation.
Leave and mandatory benefits
- Paid vacation. Under the Holidays with Pay Act, 3 weeks (15 working days) a year under 5 years of service, rising to 4 weeks (20 days) after 5 completed years. Vacation pay equals basic pay and must be paid before the leave starts. It cannot be forfeited or cashed out except on termination.
- Public holidays. 12 national public holidays, including Errol Barrow Day, National Heroes Day and Kadooment Day. One falling on a Sunday is observed the following Monday. Work on a holiday or rest day is paid at double time.
- Sick leave. A medical certificate is required beyond 2 consecutive days. Market practice is 14 to 21 working days of employer-paid sick leave a year. For prolonged illness the NISSS Sickness Benefit pays 66.67% of average insurable earnings for up to 26 weeks, extendable to 52.
- No 13th month. Barbados has no statutory bonus, profit share or Christmas payment.
- Maternity. 12 weeks under the Employment of Women (Maternity Leave) Act after 12 months of service, including at least 6 weeks of rest after confinement. NISSS pays 66.67% of insurable earnings; employers customarily top up to full salary. There is no statutory paternity leave: leading employers contract for 5 to 10 working days.
- Working time. 40 hours a week over 5 days, an unpaid meal break of at least 30 minutes after 5 continuous hours, and at least 24 consecutive hours of weekly rest. Overtime beyond 8 hours a day or 40 a week is paid at 1.5 times basic. Managerial staff can be exempted only if the contract says so expressly.
- Supplementary benefits. Not statutory but expected in the corporate market: private medical and dental cover, typically 70% to 100% employer-subsidised, a pension match of 3% to 6%, and discretionary bonuses of 5% to 20%.
Termination and notice periods
The Employment Rights Act, 2012 gives Barbados one of the most rigorous dismissal frameworks in the Caribbean. Probation runs up to 6 months. After that, a dismissal is unfair unless the employer proves the reason was capability, conduct, genuine redundancy, or a statutory restriction. For conduct and performance the Fourth Schedule procedure is mandatory: a written statement of the alleged failing with an invitation to a hearing, the hearing with the employee entitled to be accompanied, then a written decision and a right of appeal. Skip it and the dismissal is unfair automatically.

- Redundancy severance is graduated. After 104 continuous weeks, redundancy pays 2.5 weeks' basic pay per completed year for years 1 to 5, 3.0 weeks for years 6 to 10 and 3.5 weeks for years 11 to 33, capped at 33 years. Employers can claim against the national Severance Fund.
- Get the written particulars out on time. Section 13 of the ERA requires a full written statement within 28 calendar days of the start date, including the disciplinary and appeal procedures. Missing it is itself a statutory complaint.
- The Tribunal can order reinstatement. Dismissal without notice is defensible only for serious proven misconduct with a documented investigation. Otherwise the Tribunal can reinstate, re-engage or award substantial compensation.
Can I use independent contractors?
Only for genuinely independent specialists doing discrete work. Barbadian courts and the Labour Department apply the common law multi-factor test: does the principal dictate how, when and where the work is done; is the worker integral to core operations or do they carry real profit and loss risk; who supplies the computer, the software licences and the company email; and can the individual serve other clients. Full-time exclusive staff on contractor paperwork fail that test. On recharacterisation you owe retroactive NISSS contributions with late fees, retroactive PAYE with penalties, unpaid vacation, holiday and overtime arrears, and an unfair dismissal and severance claim on top. For anyone who works like an employee, an EOR is the compliant route.
The legal framework in brief
Barbadian employment law blends English common law with codified protection and a strong emphasis on procedural fairness. Any contract term that waives a statutory right is void. The instruments you will hear referenced most:
- Employment Rights Act, 2012 (ERA). Written particulars, pay statements, lawful deductions, disciplinary and grievance procedure, notice, unfair dismissal and the Tribunal.
- Severance Payments Act (Cap. 355A). Redundancy definitions, the graduated severance formula and claims against the national Severance Fund.
- Holidays with Pay Act (Cap. 348). Vacation accrual, holiday pay calculation and minimum rest entitlements.
- National Insurance and Social Security Act (Cap. 47). Compulsory social insurance, benefits and contribution liability.
- Safety and Health at Work Act, 2005 (SHaW). Occupational safety, workplace standards and health and safety committees.
- Data Protection Act, 2019. A GDPR-aligned regime: employee data needs a lawful basis, and cross-border transfers need adequate safeguards such as standard contractual clauses.
- Immigration Act (Cap. 190). Work permits run short-term to 11 months or long-term to 3 years, renewable, both subject to labour market testing. CARICOM nationals with a CSME skills certificate are exempt. The Barbados Welcome Stamp is a 12-month remote work visa whose holders stay outside PAYE and local social security if they do not enter the domestic labour market.
- Authorities. Labour Department, Employment Rights Tribunal, Barbados Revenue Authority (TAMIS) and NISSS. Collective redundancies require advance written notice to the Chief Labour Officer.
