Do I need a local entity in Saint Lucia to hire?

No. There are three routes:

  • Employer of Record. Dryft Global employs the person through a compliant local employer registered with the National Insurance Corporation (NIC) and the Inland Revenue Department (IRD), issues the Section 14 written contract and runs payroll against both monthly deadlines. You direct the work.
  • Direct local entity. You file with the Corporate Registry, open NIC and IRD accounts and retain a local accountant: 8 to 14 weeks before anyone gets paid.
  • Independent contractor. Lawful only for a genuinely independent business. Someone working inside your operation under your supervision fails the Labour Act's distinction test.

When should I use an EOR instead of registering locally?

Use an EOR to onboard in 3 to 7 business days instead of waiting on the Corporate Registry, and to build a team of 1 to 15 roles without standing up local tax and NIC administration. Your own entity earns its keep when you need premises or a Free Zone footprint at Vieux Fort.

What does an employee actually cost beyond salary?

Plan for roughly 27% to 35% on top of gross base salary. The only statutory employer contribution is NIC at 5.00% of insurable earnings, capped at XCD 5,000 a month, about USD 1,851.85, so the employer side stops at XCD 250 a month. Paid leave accrual, major medical and a pension match make up the rest. There is no employer-side income tax; PAYE is withheld from the employee.

How difficult is termination in Saint Lucia?

Structured rather than hard, but there is no at-will employment. Section 131 requires a valid, fair and documented reason for every termination: misconduct, incapacity or genuine redundancy. Notice rises with tenure, redundancy after at least 1 year of service triggers Section 156 severance, and the Labour Commissioner must get written notice 30 days before the dismissal.

What an employee costs in Saint Lucia

Saint Lucia is inexpensive on statutory employer cost: one employer contribution, NIC, matched by the employee and capped at a low ceiling, so the effective rate falls quickly on professional salaries. Paid leave is the larger accrual. The guide models a knowledge worker on USD 3,200 a month.

The vacation and holiday lines are accruals, not monthly cash. Counting cash items only, the guide's worked example puts a USD 3,200 a month salary at USD 3,740.59 all-in before the EOR fee, a burden of USD 540.59 or about 16.9% over base. Because NIC stops at XCD 5,000 a month, that share falls as salaries rise. Ask us for a current cost model.

Payroll and tax

Wages are paid monthly or biweekly. Salaries can be stated in XCD or USD at the fixed 2.70 peg under the Eastern Caribbean Central Bank, so there is no currency risk to hedge. Two deadlines drive the month, and they are not the same date: NIC by the 7th of the following month, PAYE to the Inland Revenue Department by the 21st. Missing the 7th is the most common compliance failure here. Register with the IRD for PAYE withholding and with NIC within 7 days of hiring.

Graduated PAYE withholding

Saint Lucia taxes personal income and the employer is the withholding agent. The schedule is progressive: a personal allowance covering the first XCD 18,000 to 20,000 a year at 0%, then bands at 10% and 20%, and a top marginal rate of 30%. Thresholds move, so confirm the schedule with the Inland Revenue Department before you put a net-pay figure in an offer letter.

Statutory minimum wage

Saint Lucia sets wage floors through the Minimum Wage Order framework rather than a single flat rate, so the floor depends on the role category. The guide puts the entry point at about XCD 1,130 a month, roughly XCD 6.52 an hour. Knowledge-sector pay sits far above that, at XCD 2,500 to 8,000 or more a month, about USD 925 to 3,000. Equal remuneration is mandatory under Division 2 of the Labour Act.

Leave and mandatory benefits

  • Paid vacation. A minimum of 14 working days a year for 1 to 5 years of service, rising to 21 working days at 5 years and above. Full vacation pay must be disbursed before the leave starts, not with the next payroll.
  • Public holidays. 12 to 14 a year, including Independence Day on 22 February, Emancipation Day, Thanksgiving Day in October and National Day on 13 December. Work on a public holiday is paid at 2.0 times the normal hourly wage.
  • Sick leave. Up to 14 days a year, on a medical certificate for absences over 2 days. For illness lasting 4 or more continuous days the NIC Sickness Benefit pays 65% of insurable wages, and employers customarily bridge to full salary.
  • Maternity. 13 weeks of continuous leave, typically 6 weeks before and 7 weeks after delivery. NIC pays 65% of insurable earnings and employers usually top up.
  • Paternity. Not statutory. Leading employers offer 5 to 10 paid days, so treat it as a contract term rather than a legal obligation. There is no mandatory 13th month payment.
  • Working time. 40 hours a week over 8 hours a day, an uncompensated meal interval of 30 to 60 minutes and at least 2 consecutive rest days a week. Overtime beyond 8 hours a day or 40 a week is paid at 1.5 times. Bona fide managerial staff are exempt, but the exemption must match the real role.
  • Supplementary benefits. Not statutory but expected for skilled roles: major medical covering regional healthcare, a pension match of 3% to 5%, and a remote workspace allowance of USD 75 to 150 a month.

Termination and notice periods

Probation runs to a maximum of 6 months and the terms must be stated in the original agreement. After that, Section 131 requires a documented reason for dismissal and the statutory notice schedule applies. A contract can improve on it but not cut it back.

  • Severance starts at 1 year. Under Section 156, redundancy after at least 1 year of continuous service pays 1 week of basic pay per completed year for 1 to 5 years of service, 2 weeks per year for 5 to 10 years, and 3 weeks per year for 10 years and above.
  • The Labour Commissioner gets 30 days' notice. Redundancy requires written notice to the employee and to the Labour Commissioner at least 30 days before the dismissal. That is a filing, not a courtesy call, and skipping it is a common and expensive mistake.
  • At-will termination does not exist. Reasons must be documented at the time and must fall within misconduct, incapacity or genuine operational redundancy, so build the evidence file as you go.
  • Disputes go to the Labour Tribunal. Unfair dismissal, unpaid overtime and severance claims are heard there, under the Eastern Caribbean Supreme Court appellate structure.

Can I use independent contractors?

Only where the person is genuinely running their own business. The Labour Act's distinction test looks at supervisory control, integration into your operation, ownership of equipment and economic exclusivity. A full-time worker who reports to your managers, uses your systems and bills you for nearly all of their income is an employee whatever the contract says. Getting it wrong produces several liabilities at once: retroactive NIC contributions at the combined 10%, IRD PAYE back taxes, statutory interest on both, and claims for unpaid overtime and severance before the Labour Tribunal. The tax exposure is larger here than in the zero-income-tax islands nearby. For anyone who works like an employee, an EOR is the compliant route.

The legal framework in brief

Saint Lucia is a mixed jurisdiction: English common law procedure and public law, a Civil Code legacy in property and contract, and the Eastern Caribbean Supreme Court above it. The instruments that matter:

  • Labour Act No. 37 of 2006 (as amended). The primary statute and one of the most comprehensive labour codes in the Caribbean: contracts, hours, overtime, leave, termination, redundancy and safety in one place.
  • Section 14. The written particulars due within 14 days of engagement: job description, compensation, overtime rules, holiday entitlement, notice periods and disciplinary procedure.
  • Sections 131 and 156. Documented reasons for termination, and the tenure-based severance formula.
  • National Insurance Corporation Act (Cap 16.01). Employer registration, insurable wage caps, contribution collection and the sickness, maternity and pension benefits employees draw.
  • Equality of Opportunity and Treatment in Employment Regulations. Anti-discrimination and equal remuneration, reinforced by Division 2.
  • Occupational safety and health. Division 4 of the Labour Act sets standards that reach remote workspaces.
  • Data protection. No GDPR-style statute; obligations rest on regional privacy standards and common law confidentiality. Write the controls into the contract: MDM enrolment, remote wipe, encrypted SSDs and zero-trust cloud access.
  • Immigration and right to work. Citizens and CARICOM Single Market and Economy skills certificate holders work without permits. Other foreign nationals need a Department of Labour permit, granted on proof that no suitable Saint Lucian national is available. The "Live It" visa lets qualifying remote workers live on-island for up to 12 months while working for an overseas entity.
  • Authorities. The Department of Labour under the Ministry of Commerce, Manufacturing, Business Development, Cooperatives and Consumer Affairs, the National Insurance Corporation and the Inland Revenue Department.

Where the talent is

About 180,000 people, and a market that has done outsourced professional work long enough to have real supply: business process outsourcing, customer experience, shared financial services and digital marketing support. Sir Arthur Lewis Community College, regional University of the West Indies campuses and strong vocational institutions feed accounting, IT, software support and operations roles, with an ACCA-qualified finance layer used to IFRS and international audit. English is official and Saint Lucian French Creole (Kwéyòl) is widely spoken. Atlantic Standard Time matches the US East Coast in summer and runs 1 hour ahead in winter. The constraint is at the top of the technical range: senior software architects are in demand regionally and need competitive packages to retain. Subsea fibre from FLOW and Digicel Business is redundant, and home broadband of 100 to 300 Mbps with an LTE dongle runs cloud workflows reliably.
